These Terms and Conditions ("Terms") govern your use of the website operated by SparkPath Rentals LLC ("SparkPath," "we," "us," or "our") at sparkpathrentals.com (the "Site"), and any portable restroom, temporary fencing, or related rental services we provide.
By accessing the Site or using our services, you agree to these Terms. If you do not agree, do not use the Site or our services.
1. Eligibility
You must be at least 18 years old and located in the United States to use our services. By using the Site, you represent and warrant that you meet these requirements.
2. Services
SparkPath provides portable restroom rentals, temporary fencing rentals, and related services in selected service areas across the contiguous United States. Service availability, pricing, and delivery times depend on your location, rental period, and equipment selection.
3. Quotes, Booking, and Payment
- Quotes are estimates based on the information you provide and are valid for the period stated when issued
- A booking is confirmed only upon written or recorded verbal confirmation and, where applicable, receipt of payment or a valid payment authorization
- You authorize us (or our payment processor) to charge your selected payment method for rental fees, delivery, pickup, damage, late return, and any other agreed charges
- Taxes, fees, and surcharges may apply and will be disclosed before booking
4. Cancellation and Changes
Cancellation, rescheduling, and change requests are subject to our then-current policy disclosed at the time of booking. Last-minute cancellations may incur fees that reflect our costs.
5. Your Responsibilities
- Provide accurate site, access, and timing information so we can deliver and pick up the equipment safely
- Ensure that the delivery site is accessible, safe, and on a stable surface free from obstructions
- Use the equipment only for its intended purpose and follow any safety or usage instructions we provide
- Pay for any loss of, or damage to, the equipment beyond normal wear and tear
6. Service Disclaimer
THE SITE AND OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SPARKPATH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPARKPATH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
8. Indemnification
You agree to indemnify and hold SparkPath and its affiliates, officers, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or our services, your breach of these Terms, or your violation of any law or the rights of any third party.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is owned by SparkPath or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent.
10. Privacy
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Site or our services will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
12. Termination
We may suspend or terminate your access to the Site or our services at any time, with or without notice, for any reason, including for any violation of these Terms.
13. Severability and Entire Agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and SparkPath regarding the Site and our services.
